The bill has been signed by Governor Haslam.

Both the House and Senate rescheduled when the bill would come to the floor in each chamber. The bill was on the Senate Calendar for 4/06/15 and is on the House Calendar for 4/08/15.

  • Bill Information

    Defines an “interchangeable biological product” as a biological product determined to be interchangeable by FDA or a product that has been deemed therapeutically equivalent by FDA.

    Directs a prescriber to allow substitution with an interchangeable biological product, unless

    —prescriber determines the medical necessity of a prescribed biological product because the biosimilar has previously caused adverse reaction or shown to be ineffective, or there is another clinically-based need; or

    —an interchangeable is not available.

    Permits the dispensing of an interchangeable biological product in place of the prescribed biologic, provided that:

    —the biologic is labeled with the name of the manufacturer;

    —pharmacist notifies the patient by noting substitution on the prescription label;

    —pharmacist notifies the prescriber within a reasonable time (under HB 572) or 5 days (under SB 984), electronically if possible, (and by other means if not), except when there is no FDA-approved interchangeable biosimilar or the prescription is a refill that is unchanged from the prior filling; and

    —pharmacist retains record of biologic products dispensed.

    Establishes that a pharmacist who substitutes a biosimilar is not subject to greater liability than would be incurred in filling the biologic prescription.

    The requirements do not apply to inpatients of a hospital, nursing home, or an assisted-care living facility. Notification and communication requirements do not apply to vaccines.

    Directs the Board to maintain on its website a list of approved interchangeable products.

    (SB 984 only) Clarifies with regard to electronic communication from pharmacist to prescriber, that, if Tennessee mandates electronic medical records, the electronic notification would not be required until the appropriate system is in place.
